We have brought up the issue of No Refusal Weekends, where cooperation between local law enforcement, the State’s Attorney’s office and a local judge result in a DUI roadblock where you cannot refuse to give blood, breath or urine.
The way these roadblocks work is simple. If you are stopped and they believe you may be under the influence of alcohol, the police will make you pull over to a special area. You will be asked to perform field sobriety tests. You will also be asked to blow into a breathalyzer. If you refuse, you will be asked to give blood. If you refuse THAT, the police will get a search warrant for your blood, which you cannot refuse. You will then be escorted into an ambulance where you will be forced to give a vial of your blood.
